Terms of Service

These Terms govern your access to and use of creativecore.ai, our diagnostic, and any paid services provided by Creative Core AI. By using the Service, you agree to these Terms.

1. The Service

AI-powered marketing operations consulting and execution, including a free diagnostic and paid engagement tiers. Specific scope is defined in a separate Statement of Work.

2. Eligibility and account

You must be at least 18 years old and legally able to contract.

3. Diagnostics and recommendations

The diagnostic output is informational, not legal or investment advice.

4. Payment

Fees, billing, and refunds are set out in your SOW. Fees are in USD, exclusive of taxes, billed in advance.

5. Acceptable use

You may not violate laws, submit unlawful content, reverse-engineer our systems, resell the Service, or interfere with security.

6. Intellectual property

Our IP remains ours. Your IP remains yours, licensed to us solely to deliver the Service. Deliverables are licensed to you upon payment unless otherwise stated.

7. Third-party platforms

We are not responsible for third-party platform availability, terms changes, or enforcement.

8. Disclaimers

The Service is provided "AS IS." We disclaim all warranties and do not warrant any specific business result.

9. Limitation of liability

We are not liable for indirect, incidental, special, consequential, or punitive damages. Aggregate liability is capped at fees paid in the 12 months preceding the claim or $500, whichever is greater.

10. Indemnification

You agree to indemnify us for claims arising from your breach, violation of law, or content you provide.

11. Termination

Free use may stop at any time. Paid engagements terminate per the SOW. Surviving sections include IP, disclaimers, liability, and indemnification.

12. Governing law and venue

Governed by Texas law. Disputes resolved in Harris County, Texas courts.

13. Changes to these Terms

Continued use after updates constitutes acceptance.

14. Entire agreement; severability; assignment

These Terms plus any SOW constitute the entire agreement.
